ACTION: Expose Reckless Politicians who Reveal Government Confidences - e.g., Harry Reid On May 12, 2005, Senator Harry Reid (D-NV) was discussing the judicial nominees. He referred to “a problem” in the nominee Henry Saad’s “confidential report from the FBI.” The FBI investigated all judicial nominees. Their reports are highly confidential because it can include not only true findings but also unfounded accusations from opponents and other antagonists. Here is an article : “ Reid cites FBI file on Judicial Pick” by Charles Hurt THE WASHINGTON TIMES Mr. Hunt points out that "Memorandum of Understanding" covering the use of FBI background reports limits access to committee members and the nominee's home-state senators. Mr. Reid would fall into neither category. Disclosure of confidential FBI reports can trigger severe sanctions. Since the reports are confidential, the mention of a “problem” in a public forum which cannot rightfully be explained to the public increases the doubt in the public’s mind about the nominee. Their reputation is tarnished with explanation. The nominee is allowed no rebuttal since he is not allowed to see the file. Mr. Saad sits on Michigan Appeals Court judge who is nominated to the U.S. Court of Appeals for the 6th Circuit. Mr. Reid may have violated Standing Rule of the Senate 29, Section 5: "Any Senator, officer, or employee of the Senate who shall disclose the secret or confidential business or proceedings of the Senate, including the business and proceedings of the committees, subcommittees, and offices of the Senate, shall be liable, if a Senator, to suffer expulsion from the body; and if an officer or employee, to dismissal from the service of the Senate, and to punishment for contempt."
